EULA - End User License Agreement



End user license agreement (shareware and full version)

In the following the conditions as per contract for the use of this software program are specified by you (either a person or a legal entity), the user. By accepting the present Treaty and the installation of the software you explain yourselves bound to the regulations of the present Treaty. Manufacturer and owner of the copyright of the software is called Mr. Martin Rhinow, in the following RhinoSoft.

1. Contractual item
The subject of the present Treaty is the computer program noted on the data media, the program description (operating instructions) as well as other associated written material. They are called software in the following.

2. Right to use as shareware version
A shareware version of the software is identifiable by the starting splash window and by the first window with buttons after the program start, in which the software is called expressly Unregistered Shareware. The shareware version of the software may be installed on as many as desired computers (also in the network). The software copies remain property by RhinoSoft. Modifying, reverse engineering, recompiling or disassembling of the software are not permitted.

3. Right to use as full version
Only by using an authorised registration key given from RhinoSoft the software may be switched to a full version by the user. A user, who has received an authorised registration key from RhinoSoft, is called licensee in the following. The licensee is obligated to keep the registration key in such a way secret that no third person can get knowledge of it. The procedure of switching from shareware version to full version is described more exactly in the program help file. A full version of the software can run as unregistered full version or as registered full version. A unregistered full version of the software is identifiable by the first splash window and by the first window with buttons after the program start, in which the software is called expressly Unregistered Single Licence. The licensee is obligated to switch the unregistered full version by input of the registration key as soon as possible into a registered full version. A registered full version of the software is identifiable by the starting splash window, which designates the licensee (user). The shareware window after the program start is void with the registered full version.

On the condition that the software is an authorised full version, RhinoSoft gives to the licensee the untransferable personal right (license), to use copies of this RhinoSoft program on maximally two computers at the same time. The program is used on a computer, if it is copied into the temporary memory (i.e. RAM). These software copies and every other copy, the licensee is entitled to use in the context of the present Treaty, remain property by RhinoSoft. The software may be used by the licensee only as full version. If the software is an updated program version (update), the license for the past version expires automatically with the installation of the update. The licensee is no longer entitled to use this further and commits itself to immediately destroy all copies and installations of the past version irreparably. In all other cases he offends against the license agreement. Modifying, reverse engineering, recompiling or disassembling of the software are not permitted. All in this license agreement not expressly granted rights of usage remain with RhinoSoft. Licensees are responsible for all damage, which develops for RhinoSoft due to the injury of this license agreement.

4. Duplication
The software as well as all associated written material are property by RhinoSoft, and protected by copyright laws, international contracts and other national legislation. The copyright notes, registered trade mark notes and registration numbers existing in the software may neither be removed nor changed. Duplication of a possibly provided manual or other associated written materials is not permitted. The documentation of the program is implemented anyway as an on-line help. The user may do a printout only for own purpose.

5. Limited Warranty and Disclaimer
RhinoSoft warrants to the licensee, that any physical media included with the product, as and when provides to you, will be free of physical defects in materials and workmanship for a period of 90 days after the date you initially aquire the software. Your exclusive remedy and RhinoSoft's sole liability for breach of this warranty is that RhinoSoft will replace and defective media returned to RhinoSoft within the 90 day warranty period. This warranty does not apply to damage resulting from misuse, abuse or neglect. Any replacement media will be warranted as above for the remainder of the original warranty period or 20 days from the date we ship it to you, whichever is longer.

Except for this express limited warranty, the software is provided as is and without warranty of any kind. RhinoSoft hereby excludes and disclaims all implied or statutory warranties, including any warranties of merchantability, fitness for a particular purpose, quality, non-infringement, title, results, efforts or quiet enjoyment. There is no warranty that the software will be error-free or will function without interruption. You assume the entire risk for the results obtained using the software. To the extent that RhinoSoft may not disclaim any warranty as a matter of applicable law, the scope and duration of such warranty will be the minimum permitted under such law.

Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. This limited warranty gives you the specific legal right, and you may also have other legal rights, which vary from state to state.

6. Safety device of the license.
RhinoSoft may send the following data of the licensee to a server, to examine the license: Name, address and registration key. It is forbidden that RhinoSoft transfers these dates to third parties.

7. Sale of the rights at the software
At any time RhinoSoft can sell the copyrights of the software to a third party. In such a case all rights and obligations change from RhinoSoft to the purchaser of the copyrights of the software.

8. Area of jurisdiction
Area of jurisdiction for disputes from the present Treaty is Munich.

9. Partial validity
If individual regulations of this license agreement should be totally or partly ineffective and/or incomplete, then thereby the validity of the remaining regulations is not affected. The ineffective and/or incomplete regulation has to be replaced by such, whose economic and legal sense comes closer to the unsatisfactory regulation.
